3 <br /> STATE OF NORTH CAROLINA <br /> COUNTY OF- Orange <br /> MEMORANDUM OF UNDERSTANDING <br /> This Memorandum of Understanding (MOU) is entered into by <br /> and between the State of North Carolina, Department of Crime <br /> Control and Public Safety, Division of Emergency Management <br /> (hereinafter Division of Emergency Management) , and the County <br /> of Orange State of North Carolina. <br /> (hereinafter Orange County) . <br /> WHEREAS, the Division of Emergency Management is the <br /> designated agency for the disbursement of United States <br /> Department of Transportation funding for training and planning <br /> for hazardous material transportation and emergency response; <br /> WHEREAS, seventy-five percent (75%) of the planning grant <br /> funding is to be passed on to local governments in the form of <br /> grants for the improvement of planning; and <br /> WHEREAS, the County of Orange has <br /> submitted a grant application for receipt of these funds dated <br /> the 29th day of June , 1995 . <br /> NOW, THEREFORE, in consideration of the following covenants <br /> between the parties, the Division of Emergency Management shall <br /> provide a grant payment of $200 . 00 to <br /> Orange County contingent upon the availability <br /> of funds . <br /> For and in consideration of this grant payment, <br /> Orange County agrees as follows : <br />
