Z-4-96 Charles Davis <br /> Request initiated by property owner to rezone approximately 105 acres <br /> located adjacent to the Hillsborough and Orange Count} I-40/NC 86 <br /> Economic Development Districts from R-1 to R-3. <br /> ZONING ORDINANCE TEXT AMENDMENTS <br /> 1. Efland Setback Overlay District <br /> The proposed amendment to the Zoning Ordinance establishes the intent <br /> and application criteria for a new overlay district, (See also Zoning Atlas <br /> Amendment Z-5-96 above.) <br /> 2. Temporary Outdoor Events <br /> This item is a request by Patricia and Paul Tripodi, owners of Tripodi's <br /> catering, to consider an amendment to the Zoning Ordinance to create a <br /> new Special Use category called "Temporary Outdoor Events" . In the <br /> case of the applicant, the amendment would allow the on-site hosting of <br /> wedding receptions and other events in connection with the existing <br /> catering business operated from the applicants home. The amendment was <br /> originally proposed by the Planning Staff and was to be presented for <br /> public hearing on February 28, 1996. There were concerns raised by the <br /> Planning Board and Board of Commissioners as to how such events would <br /> be defined, to assure that events such as horse shows, and church and <br /> civic events would not become subject to Special use Permit approval. <br /> Due to the concerns raised, the Board of Commissioners did not approve <br /> inclusion of the item on the February public hearing agenda. The <br /> Tripodi's have made application and paid applicable fees to have the <br /> amendment presented at the August public hearing. <br /> SUBDIVISION REGULATIONS TEXT AMENDMENTS <br /> 1. Cluster Developments <br /> On May 1, 1996, the Board of Commissioners approved the flexible <br /> development regulations, and the previous ordinance provisions for <br /> cluster developments were eliminated. However, the flexible <br /> development regulations do not apply in the Rural Buffer. The proposed <br /> amendment would re-adopt the previous cluster provisions in the Rural <br /> Buffer, allowing cluster developments as an alternative to conventional <br /> subdivision design until other regulations are approved by the governing <br /> boards of Orange County, Chapel Hill and Carrboro. <br />
