6 <br /> COMPLIANCE WITH STATEIFEDERAL POLICY <br /> The County, and/or its agent, including all contractors, subcontractors, or sub-recipients shall <br /> comply with all applicable Federal and State policies and procedures,stated both in this <br /> Agreement and in the Department's guidelines and procedures. <br /> FAILURE TO COMPLY-CONSEQUENCES <br /> Failure on the part of the County to comply with any of the provisions of this Agreement will be <br /> grounds for the Department to terminate participation in the.costs of the Project and,if applicable, <br /> seek repayment of any reimbursed funds. <br /> 2. SCOPE OF PROJECT <br /> The Project consists of the construction and operation of a Park and Ride shelter at the Durham <br /> Technical Community College,which will provide transit service to downtown Hillsborough, and <br /> the installation of four bicycle racks on Orange Public Transportation Buses. The Department's <br /> funding participation in the Project shall be restricted to the following eligible items: <br /> • Planning/Design <br /> • Construction <br /> • Operating Expenses <br /> as further set forth in this Agreement. <br /> 3. FUNDING <br /> For Federal Fiscal Year 2009, subject to compliance by the County with the provisions set forth in <br /> this Agreement and the availability of federal funds, the Department shall participate as detailed <br /> below in the FUNDING TABLE, subject to the following conditions: <br /> 1. If the County submits all required pre-construction documentation by August 29,2009, <br /> then the Department will reimburse 100% of the project costs up to a maximum of <br /> $218,275 [100%]. <br /> Agreement ID# 149 3 <br />
