Memorandum of Understanding <br /> Page 2 of 3 <br /> 3 <br /> 4. Benefits <br /> The School of Public Health will continue Dr. Summers' benefits as an employee of the <br /> School of Public Health during the period covered by this understanding. <br /> 5. Work Hours/Schedule <br /> The School of Public Health agrees to an 80 percent effort commitment for Dr. Summers to <br /> Orange County with a continuing 20 percent commitment to the School. The School agrees <br /> Dr. Summers has flexibility as to the specific time and scheduling of the commitment to the <br /> School. In the event of public health or other emergency, the School agrees Dr. Summers <br /> may adjust her schedule to meet the County's need. <br /> 6. Cost and Cost Distribution <br /> To reflect the time and effort distribution, the County will pay 80 percent of the cost of Dr. <br /> Summers' salary and benefits and the School will pay 20 percent. The County's share of Dr. <br /> Summers salary and benefits is$5,491 a month. The County will reimburse the School of <br /> Public Health in the amount of$5,491 a month for Dr. Summers' services. <br /> 7. Payment Schedule <br /> The University will bill the Orange County Health Department on a monthly basis with the <br /> first bill being dated January 5, 1998. The Orange County Health Department will pay the <br /> University within 30 days of receipt of the University's bill. <br /> 8. Personnel Responsibility <br /> During the term of this agreement,Dr. Summers will continue to be an employee of the <br /> School of Public Health and will not be a County employee. <br /> 9. Professional Liability Insurance <br /> Since Dr. Summers continues as an employee of the School of Public Health and is not a <br /> County employee,professional liability insurance coverage will be that provided by the <br /> School for exposure not covered by North Carolina Tort Law. <br /> 10. Termination Provision <br /> Either the University or the County may terminate this understanding at any time without <br /> penalty with 30 days advance written notice. <br /> 11. Applicability of Law <br /> The laws of North Carolina shall govern the validity and interpretation of the provisions, <br />
