Article 5: Uses <br />Section 5.13: Standards for Agricultural Uses <br />The Operations Plan and the Rehabilitation Plan shall be coordi9xted so <br />that the amount of disturbed land is kept to the absolute minim m <br />consonant with good practices and so that rehabilitation pro eds in <br />oncert with extraction. <br />(1) No nd disturbance shall take place within 250 feet of e zoning lot line <br />or th roperty line where the zoning line and the pr erty line are one <br />and the ame. Within the 250 foot setback area isting vegetation <br />shall be r ined for the purpose of providing a sual screen and noise <br />buffer. No turbance or removal of vegetati shall be permitted <br />except for acc s roads leading from the e avation area to public <br />roads. Where ve tation within the 250 f t setback does not exist, the <br />applicant shall be r uired to provide ense, evergreen buffer <br />consistent with the pu ose cited ab e. The buffer shall be in place <br />prior to the initiation of a excav on activities. <br />(m) The applicant shall submit o tional reports, prepared on an annual <br />basis, detailing the amounts aterials extracted, extent of extractive <br />area, depth of extractive a a, an results of groundwater test borings. <br />(n) Annual inspections of e operations all be conducted by the Planning <br />Director following su ittal of the annu operations reports to determine <br />compliance with t provisions of the Spe ial Use Permit. <br />(o) In cases of ab donment or termination of op ations for a period of 12 <br />consecutive onths, application for a new Spec I Use Permit is <br />required. <br />(p) The B rd of County Commissioners shall require for I extractive uses <br />a pe ormance guarantee to insure that the provisions o e <br />R abilitation Plan are met. Such performance guarantee all be in a <br />rm approved by the County Attorney. The amount of such arantee <br />shall cover the cost of rehabilitation on a per acre basis, if the c t does <br />not exceed the amount posted with the State.
