25 <br /> 1 John Roberts said he has suggested to town attorneys that support of a resolution would remedy <br /> 2 the situation in the Durham County portion and the Orange County portions. He said this would remedy <br /> 3 the need for a solid waste service district in the town areas. <br /> 4 He said the legislative committees continue to pump out bills, and it does not appear that things will <br /> 5 be finished two weeks from now. He said that his legislative update will likely come to the Board during <br /> 6 summer break. <br /> 7 Commissioner porosin asked if there was any feedback from the towns on the proposal about solid <br /> 8 waste. <br /> 9 John Roberts said he made the proposal months ago. He said the towns felt there was no <br /> 10 authority and it is still being considered. <br /> 11 Commissioner porosin noted that the court of appeals overruled the Chapel Hill cell phone case. <br /> 12 He said there is some interesting language on local government authority and he would love a summary of <br /> 13 this. <br /> 14 John Roberts said it seems to be limited to police power and the Court of Appeals didn't address <br /> 15 the cell phone ordinance. He said the court essentially said that the plaintiff was not in any imminent <br /> 16 jeopardy of being penalized under the cell phone rule, thus it was overturned. The court did say that <br /> 17 Chapel Hill did have the power to enforce towing regulations. <br /> 18 Commissioner Rich questioned if this might be a victory in many ways. <br /> 19 John Roberts said that general consensus on the attorney list serve was that this towing ordinance <br /> 20 was a bad decision, but there was no discussion of the cell phone issue. <br /> 21 <br /> 22 11. Appointments <br /> 23 <br /> 24 a. Oranqe County Board of Adiustment— New Appointments <br /> 25 The Board considered making new appointments to the Orange County Board of Adjustment. <br /> 26 <br /> 27 <br /> 28 A motion was made by Commissioner Gordon, seconded by Commissioner Pelissier to appoint <br /> 29 Karen Barrows to the #5, At-Large position on the Orange County Board of Adjustment, with a term <br /> 30 expiration of 6/30/2015. <br /> 31 <br /> 32 VOTE: UNANIMOUS <br /> 33 <br /> 34 A motion was made by Commissioner porosin, seconded by Commissioner McKee to appoint <br /> 35 Samantha Cabe to the # 6 position (Alternate) with a term expiration of 6/30/2015. <br /> 36 <br /> 37 VOTE: UNANIMOUS <br /> 38 <br /> 39 A motion was made by Commissioner McKee, seconded by Commissioner Price to appoint Jeff <br /> 40 Schmidt to # 3, At-Large Position, with a term expiration of 6/30/2016. <br /> 41 <br /> 42 VOTE: 6-1 (Commissioner porosin) <br /> 43 <br /> 44 <br /> 45 b. Oranqe County Planninq Board —Appointments <br /> 46 The Board considered making appointments to the Orange County Planning Board. <br /> 47 <br /> 48 A motion was made by Commissioner porosin to nominate Brendan Madigan to the #8 At-Large <br /> 49 position on Orange County Planning Board, with a term expiration date of 3/31/2016. <br /> 50 No second. Motion fails. <br /> 51 <br /> 52 A motion was made by Chair Jacobs, seconded by Commissioner Price to nominate Randy <br /> 53 Marshall to the #8 At- Large position on Orange County Planning Board, with a term expiration date of <br /> 54 3/31/2016. <br />
