13 <br /> obligations with respect to the 1997 Advance shall be secured by the provisions of the Contract <br /> and the Deed of Trust, including a security interest in that portion of the real property subject to <br /> the Deed of Trust which is described in Exhibit B. <br /> 5. Notwithstanding any other provision of this Modification Agreement or the <br /> Original Documents, the Grantor, the Deed of Trust Trustee and Beneficiary intend that this <br /> transaction comply with North Carolina General Statutes Section 160A-20. No deficiency <br /> judgment may be entered against the Grantor in violation of such Section 160A-20, including, <br /> without limitation, any deficiency judgment for amounts that may be owed under this agreement <br /> or the Original Documents when the sale of all of the Property,as defined in the Deed of Trust, is <br /> insufficient to produce enough money to pay in full all Installment Payments, as defined in the <br /> Contract, and other amounts payable under the Original Documents.. <br /> 6. Beneficiary shall attach a copy of this Modification Agreement to the original <br /> copy of the Contract. Grantor shall cause a fully-executed original copy of this Modification <br /> Agreement to be recorded in the real estate records in the office of the Register of Deeds of <br /> Orange County,North Carolina. <br /> 7.
