In order for clustering to be achievable in rural Orange County.it requires a maximum <br /> of 20%open space with a minimum lot size of I acre.Land is the greatest expense in <br /> rural developments while infi astructurc (water/sewer,roads)is the greatest expense in <br /> urban areas. Urban developments recoup costs with higher density. Rural <br /> developments, without water/sewer,must have a minimum l acre lot size. Shorter <br /> roads can cut costs but with 200' being a generous length of road frontage for a 1 acre <br /> lot. at$30 a linear foot, the saving of$6,000 does not make up for the loss of a <br /> $20,000 1 acre lot. If clustering is desirable it should be doable otherwise it is <br /> downzoning. <br /> 2. If the 5 &2 zoning with cluster configuration is enacted.an accurate calculation should <br /> be made of the parcels in the watershed with acreage over 12 acres in size. (A recent <br /> comment has been made that 25%of all existing parcels are over 12 acres in sine). If an <br /> owner of one of those parcels decides to subdivide at any time after the date of <br /> downzoning enactment,an analysis should be made of the development potential(with <br /> soil,slope etc.constraints)at the 2 acre minimum zoning versus the 5&2/cluster <br /> zoning.The difference in values should be compensated to that landowner by OWASA <br /> as a purchase of development rights hold in perpetuity,or in a Land Bank for future <br /> transfer or for a TDR program with sufficient receiving areas designated to absorb such <br /> transfers. <br /> 3. It is fundamentally unfair to make a certain segment of the population pay for the <br /> benefits of another.Fair compensation is the honorable and equitable thing to do. <br /> C-4 <br />
