f <br /> 2 <br /> Use Plan on the basis that the Plan sets forth a range of densities in Transition j <br /> Areas, but does not contemplate limitations on the ability to secure permits if <br /> proposed projects are carried out in accordance with the Plan. <br /> The letter further states that a moratorium adopted by Carrboro would have no <br /> effect in the Transition Areas until the Joint Planning Agreement was amended to <br /> "provide for moratoria, their duration, and the reasons justifying them". <br /> Current Request for Moratorium <br /> The moratorium proposed at this time is essentially the same as that proposed in <br /> early 1996. The Carrboro Board of Aldermen have set a November 11, 1997 <br /> public hearing date. <br /> There have been no changes to the Joint Planning Agreement to address <br /> development moratoria, as suggested in the February 13, 1996 letter from the <br /> Board of Commissioners. In response to the request for comment on the current <br /> proposed moratorium,the Planning Staff sent the attached letter dated October 15, <br /> 1997 to the Carrboro Planning Director. That letter cites the prior action by the <br /> Board of Commissioners objecting to a moratorium until the Joint Planning <br /> Agreement is amended. <br /> Options <br /> Since the initial request for a moratorium, there has been considerable public input <br /> into the development of the Plan. Two facilitated meetings, held in April and May <br /> of 1997, involved almost 200 citizens, elected officials and community leaders. <br /> One option would be for the Board of Commissioners reconsider its earlier <br /> decision based on additional information concerning the extent of public input on <br /> the development of the Northern Small Area Plan. If the Board takes no action to <br /> object to the proposed moratorium prior to the November 11 hearing before the <br /> Board of Aldermen,then it will be effective in the Transition Areas upon adoption, <br /> and will automatically be incorporated by reference into the Orange County <br /> Zoning Ordinance. <br /> The other option would be to conduct a public hearing to amend the Joint <br /> Planning Agreement as described in the February 26, 1996 letter from the Board <br /> of Commissioners. The governing boards of Orange County, Chapel Hill, and <br /> Carrboro will be present at an Assembly of Governments meeting on November <br /> 20, 1997. A JPA public hearing could be held prior to convening the regular <br /> meeting. A proposed legal advertisement is attached for Board approval if it <br /> wishes to schedule the hearing on November 20. <br /> RECOMMENDATION: The County Manager recommends that the Board reconsider its earlier <br /> position concerning the proposed Carrboro development moratorium based <br /> on the extent of public input in the development of the Northern Small Area <br /> Plan, and take no action objecting to the proposed moratorium. <br />
