9 <br /> The county department of social services in a Standard Program County shall <br /> be responsible for administering and implementing the Standard Work First Program <br /> in that county. <br /> (h) The Department and Electing Counties in develogin; an Electing County <br /> Work First Program or the Standard Work First Program, may distinguish istinguish among <br /> uctertial a oups of recil2ients on whatever basis necessary to enhance program <br /> irposes and to madmize federal revenues so long as the rights, including the <br /> constitutional rights of equal nrote-ctien and due process, of individuals are protected. <br /> The Department and Electing Counties may provide Work First Program assistance <br /> to le?al immigrants on the same basis as citizens to the extent permitted by federal <br /> law." <br /> Section 12.6. Part 2 of Article 2 of Chapter 108A of the General Statates <br /> is amended by adding the following new sections: <br /> 114 108A-27.1. Time limitations on assistance. <br /> (al Under the Standard Work First Progjam unless an extension or an exemption <br /> is provided pursuant to the 2rovisions of this Part or the State Plan. any cash <br /> assistance provided to a person or family in the emplovment program shall only be <br /> provided for a cumulative total of 24 months After having received cash assistance <br /> for 24-months the ,person or the family may reapply for cash assistance, but not until <br /> after 36 months from the last month the 2erson or the family received cash assistance. <br /> This subsection shall not apply to child-only cases. <br /> ases. <br /> (,b) Electing Counties may set any time limitations on assistance it finds <br /> appropriate so long as the time limitations do not conflict or exceed any federal time <br /> limitations. <br /> "& 108A-27.2. General duties of the Department. <br /> The Department shall have the following general duties with respect to the Work <br /> First Program: _ <br /> l PPiovide technical assistance to counties developing- and <br /> imp a enting their County Plans including providing information <br /> c�c ncernin- applicable federal law and regulations and changes to <br /> _ <br /> federal law and regulations that affect the permissible use of <br /> federal funds and scope of the Work First Program in-a county - <br /> 2 Describe autho-rized federal and State_ work activities:— — -�-- <br /> 3 Define requirements for assignment of child sul2- income and <br /> compliance with child support activities: <br /> Establish a schedule for counties to submit their ounty Plans to <br /> ensure that all Standard County Plans are adopted by the Standard <br /> Program Counties vv January 15 of each even-numbered year and <br /> all Electing County Plans are adopted by Electing Counties _hv- <br /> Febru= 1 of each even numbered vear and review and then <br /> recommend a State Plan to the General Assembly: <br /> Enn=e that The County Plans comply with- federal and State laws. <br /> rules and regulations are consistent with the overall pumoses and <br /> goals of the Work First Program and max'miz-. federal receipts for <br /> the Works First Program: <br /> j P,rUare the State Plan in accordance with G-5. 108A-27.9 and <br /> federal laws and rei ulations and submit 't to the Budget erector <br /> for approval: <br /> M Submit the State Plan as approved by the Budget Director, to the <br /> General Assembly for agprovah <br /> (8) Report monthly to the Joint Legislative Public Assistance <br /> Commission on the monthly progress reports submitted ,bv the. <br /> counties to the Department: <br /> _ paQP 2�3 <br />
