3
PROPOSED ORDINANCE AMENDMENT
ORDINANCE: Zoning Ordinance
Economic Development Districts Design Manual
REFERENCE: Article 3.2 - Landscape Design
ORIGIN OF AMENDMENT: X Staff Planning Board
BOCC X Public
Other:
STAFF PRIORITY RECOMMENDATION: _X_High Middle Low
Comment:
PUBLIC HEARING DATE: May 27. 1997
PURPOSE:
To consider elimination of the 100-foot buffer requirement along the perimeter of an Economic
Development District(EDD)which abuts an EDD adopted by another planning jurisdiction.
IMPACTS AND ISSUES:
Perimeter Buffer
Article 3.2 Landscape Design(page 3.2.6)of the EDD Design Manual requires al 00-foot buffer
around the perimeter of an EDD in order to separate incompatible uses.
The I-40/Old NC 86(EDD)contains about 750 acres, and extends from south of I-40 to the
southern boundary of Hillsborough's jurisdiction.
The northernmost portion of the district consists of a narrow strip of properties, ranging from 300
to 500 feet in width,on the west side of Old NC 86 between Cates Creek and Oakdale Drive. It is
zoned Primary I Overlay, which places additional limits on permitted uses in order to minimize
impacts to adjacent residential areas.
The area bounded by the east side of Old NC 86,Cates Creek and 1-85 is in the jurisdiction of the
Town of Hillsborough and is also zoned Economic Development District. Since Old NC 86 forms
a perimeter boundary for both the Orange County and the Hillsborough EDDs,it is applied on
both sides of Old NC 86 where the two districts abut. However, the uses which would be allowed
adjacent to Old NC 86 in both districts are similar and not incompatible, thus the protection which
the perimeter buffer is intended to provide is not needed.
