Landscape Architecture 550.00 As required for ZCP Cost Estimating 800.00 At schematic design and 75% completion of contract documents As Built Drawings 1,200.00 ZCP 2,200.00 Documentation and representation 12.2 Amend Article 7 with the following paragraph: 7.4 Mediation. In addition to and prior to arbitration,the parties shall endeavor to settle disputes by mediation in accordance with the Rules of Mediation Settlement Conferences as promulgated by the North Carolina Supreme Court and currently in effect. Demand for mediation shall be filed in writing with the other party to this Agreement. A demand for mediation shall be made within a reasonable time after the claim,dispute or other matter in question has arisen. In no event shall the demand for mediation be made after the date when institution of legal or equitable proceedings based on such claim,dispute or other matter in question would be barred by the applicable statute of limitations. The mediator will be chosen by the parties from that list of mediators approved by the Dispute Resolution Commission appointed by the North Carolina Supreme Court. In the event the parties are unable to agree upon a mediator,mediation of the dispute shall be deemed waived, and the dispute shall be decided by arbitration in accordance with procedures set forth in Article 7.1,7.2 and 7.3 of this Contract. 12.3 Team Fee Schedule dated June 16, 1997 attached.
