2 <br /> A CONTRACT BETWEEN i <br /> THE UNIVERSITY OF NORTH CAROLINA AT CHAPEL HILL <br /> FOR ITS SCHOOL OF PHARMACY <br /> AND THE ORANGE COUNTY HEALTH DEPARTMENT <br /> This contract is between the University of North Carolina at Chapel Hill for its School of Pharmacy, herein <br /> referred to as the School, and the Orange County Health Department, herein referred to as the Health Department. <br /> It is understood that the Division of Pharmacy Practice of the School will direct and provide consultant pharmacy <br /> services to the Health Department. It is further understood that there will be a mutual cooperation between the <br /> Chairman, Division of Pharmacy Practice, School of Pharmacy, and the Director of the Health Department in <br /> conducting the activities as described below: <br /> L The Health Department agrees: <br /> 1. to allow undergraduate and graduate pharmacy students under supervision to obtain part of their <br /> educational experience in the Health Department; <br /> 2. to provide guidance and assistance with related administrative or technical aspects of providing <br /> consultant pharmacy services as requested; <br /> 3. to participate in the ongoing evaluation of the role of the pharmacist in the local Health <br /> Department; <br /> 4. to reimburse the School of Pharmacy $416.66 per month ($5,000 per year). The School will <br /> submit a bill to the Health Department twice annually, November and May, for consultant <br /> pharmacy services provided. The Health Department will then submit a request for payment to <br /> the Orange County Finance Department. They shall prepare a check to the School based on the <br /> Finance Department's schedule which will be mailed to the School; <br /> 5. to enable the pharmacist to perform all activities mandated by all applicable laws, regulations, <br /> and standards; <br /> 6. to register the pharmacy services with appropriate state and federal agencies with the assistance <br /> of the consultant pharmacist; <br /> 7. to allow the pharmacist to participate in other related activities in the Health Department if <br /> agreed to by both parties; <br /> 8. to comply with such non-discrimination laws in its educational and/or employment practices as <br /> may be applicable in the performance of this contract. <br /> H. The University agrees that the School of Pharmacy will: <br /> 1. provide pharmacist staffing sufficient to deliver all of the activities identified in Appendix A: the <br /> staffing pattern to be following will be agreed to by the Chairman,Division of Pharmacy <br /> Practice,and the Director of the Health Department;the activities of all School personnel within <br /> the Health Department shall be the responsibility of the School; <br /> 2. be responsible for the negligence of its employees and agents to the extent of the North Carolina <br /> Tort Claims Act. Further,the University,in consultation as to amount with the OCHD,will <br /> provide adequate professional liability insurance for the University,its students and personnel, <br /> who provide the services described in the agreement. The insurance limits will be stated in a <br /> Certificate of Insurance submitted at the time the contract is commenced; <br /> 3. assure that pharmacy services meet all applicable laws,regulations and standards; <br /> 4. insure the Chairman,Division of Pharmacy Practice,or his designate's availability on an <br /> emergency basis for administrative or pharmaceutical problems that arise which are directly <br /> related to the consultant pharmacy services at the Health Department; <br /> 5. provide the supervision and evaluation of undergraduate students assigned on a rotational basis to <br /> receive experience in the provision of consultant pharmacy services;student activities may <br /> include: assisting the pharmacist in providing consultant service,participate in projects to <br /> evaluate or improve therapeutics or pharmacy related activities,present or participate in inservice <br /> education activities; <br />
