BACKGROUND: Orange County Speedway has requested that the County Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for July 3, 1997 (rain date July 5, 1997) in conjunction with the regularly scheduled race. GS 14-414, indicates that the Board shall consider a fireworks permit for"any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes." GS 14-413 empowers the Commissioner to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions...but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. Documents attached satisfy the checklist criteria previously endorsed by the Commissioners. It may be of interest to the Board that the Fire Code, as modified in 1996, allows the local fire official to specify that a plan must be developed to ensure adequate coverage for fire and emergency medical services if he/she believes that the specific public
