4 <br /> INTERLOCAL AGREEMENT <br /> CONCERNING SOLID WASTE <br /> MANAGEMENT MAT ERS <br /> This Interlocal Agreement Concerning Solid Waste Management Matters is <br /> dated as of July 1, 1997, and is by and among ORANGE COUNTY, NORTH <br /> CAROLINA, the TOWN OF CARRBORO, NORTH CAROLINA, the TOWN OF <br /> CHAPEL HILL, NORTH CAROLINA, and the TOWN OF HILLSBOROUGH, <br /> NORTH CAROLINA. <br /> WHEREAS, the parties have worked together over a period of years to develop an <br /> effective, comprehensive approach to the solid waste management issues facingAthe <br /> residents of Orange County and the towns therein, and have reached this Agreement to <br /> address those issues; <br /> THEREFORE, the parties agree as follows: <br /> ARTICLE I <br /> Purpose of Agreement; Conditions to Effectiveness <br /> 1.01. Purpose The purpose of this Agreement is to set forth the Parties' <br /> agreement to transfer operational control to the County, of the solid waste management <br /> system servingNresidents of the County and the Towns, and to establish the terms for the <br /> management of such so'M waste management system under which the Towns will <br /> participate in formulating solid waste management policy for their own residents and for <br /> Orange County as a whole. <br /> 1.02. Conditions. Notwithstanding any other provision of this Agreement, <br /> (a) no provision of this Agreement, other than the requirement to bargain as <br /> described in Section 1.03, shall become effective until the Parties have adopted the initial <br /> Solid Waste Management Plan as described in Article IV; <br /> 2 <br />
