This draft <br /> reflects only a few changes that I have made in response to the discussion at the AOG <br /> meeting on April 17,but at least one change is substantial, and I thought circulating these <br /> changes would help keep things moving along. Once we have determined the next step in <br /> this process, I will circulate a new complete draft of the agreement. <br /> The changes to Section 5.06 are intended to clarify that the express fee limitations <br /> in other sections are limitations on the County's general powers as to rates, fees and <br /> charges set forth in Section 5.06. <br /> There is a new Section 5.08, entitled "Governmental Recycling Fee." At the end <br /> of the AOG meeting, the Managers asked me to add a provision to the draft agreement <br /> that treated any general recycling fees on a basis substantially similar to increases in the <br /> mixed solid waste tipping fee. Section 5.08 is my response. <br /> You will see that Section 5.08 applies only to fees imposed directly against <br /> governments, as opposed to charges imposed against users or property owners. This <br /> approach protects the governments from changes that directly impact their budgets, <br /> thereby providing protection of the type afforded by Section 5.07 (with respect to the <br /> Mixed Solid Waste Tipping Fee).
