ORIGINAL SIGNATURES <br /> ' rf <br /> CONTRACT COPY 3 <br /> DIST:_ ,&e,& .._,... <br /> THIS AGREEMENT, made and entered into this day of August 5 1997, by and <br /> between the County of Orange, North Carolina, hereinafter called the County, and <br /> Blythe Construction, Inc. , hereinafter called the Contractor. <br /> WTTNESSETH; That the Contractor, for the consideration hereinafter fully set out, and the County, for <br /> the construction of work performed, agree as follows: <br /> 1. Scope of Work: The Contractor shall furnish and deliver all the materials and perform all the <br /> work in the manner and form as provided in the following listed Plans, Specifications, and Contract <br /> Documents, which are hereby made a part hereof, as if fully contained herein, for the Public Works Motor <br /> Pool Facility Paving Project, located in central Orange County,North Carolina. <br /> CONTRACT DOCUMENTS <br /> a. Instruction to Bidders <br /> b. Proposal . <br /> c. Contract (this document) <br /> d. MBE Requirements for Construction Contracts <br /> e. General Provisions <br /> f. Supplemental General Provisions <br /> g. Project Special Provisions <br /> h. Detailed Specifications <br /> i. Appendices <br /> j. Plans <br /> 2. Time of Completion: The Contractor shall complete the work to be performed under this <br /> Contract not later than the date set by the Purchasing Director in written Notice to Proceed, said date to be <br /> within one hundred twenty (120) days after issuance of notice. This work shall be completed within the <br /> schedule as indicated in the Supplemental Provisions unless such time of completion of the Contract Is <br /> extended by the County. Should the time of completion of this Contract be extended for any reason, such <br /> extension shall not affect the validity of the Contract. <br /> 3. Fee for Service: In consideration of the performance of the Contract, the County agrees to pay <br /> the Contractor in current funds, as compensation for his service, fees based on the actual work done at the <br /> Bid Schedule stated in the Proposal. Fees shall be paid monthly in accordance with the paragraph entitled <br /> "Partial Payment" in section 90 of the General Provisions. <br /> 4. Applications for Payment: The Contractor shall apply for payment under this Contract in <br /> accordance with the paragraph entitled "Partial Payment" in section 90 of the General Provisions. <br /> 5. Certification of Payment: The Purchasing Director shall verify the Contractor's statement of <br /> monies due under this Contract, and shall have payment issued within fifteen days for all such charges <br /> which are approved. <br /> C-1 <br />
