59 <br /> PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: ZONING ORDINANCE <br /> REFERENCE: Article 4.1 -Establishment of Use Regulations <br /> Article 6.16.18 - Additional Requirements for Certain <br /> Permitted Uses(Private Cemeteries) <br /> ORIGIN OF AMENDMENT: X Staff Planning Board <br /> _BOCC Public <br /> Other: <br /> STAFF PRIORITY RECOMMENDATION: High_X_Middle Low <br /> Comment: <br /> PUBLIC HEARING DATE: May 27. 1997 <br /> PURPOSE: <br /> To allow lots for private cemeteries to be smaller than the minimum lot size otherwise <br /> required for the zoning district. <br /> IMPACTS/ISSUES: <br /> Commercial cemeteries are allowed in some zoning districts and require approval of a <br /> Special Use Permit in most of those districts. Private cemeteries are not subject to any <br /> special state or local regulations. <br /> Requests or inquiries to the Planning Department regarding the creation of new private <br /> cemeteries are rare. However, existing cemeteries, often many years old, are sometimes <br /> located on property to be subdivided. Currently, a new lot which contains a cemetery <br /> must meet the minimum lot size of the zoning district,which could be as large as two or <br /> five acres. The cemetery itself is generally subject to an easement held by the original <br /> property owner, or other person or entity with a legal or family interest in the cemetery. <br /> The proposed amendment would allow the option for a cemetery to be owned by those <br /> with an interest in it, without requiring that it be contained within a lot which meets <br /> minimum lot size requirements. A Notice of Development Restriction would be recorded <br /> stating that the lot could not be used for any other purpose. <br />
