This notion, which allows for the eroding
away of nonconforming mobile home spaces in a nonconforming
mobile home park, is consistent with the intent of the non-
conforming use section generally. That intent is expressed in
Section 11 .4, which states "it is the intent of this ordinance
that nonconforming uses shall be considered to be incompatible
with the permitted uses within the several districts . . . . " A use
"grandfathered" by the nonconforming use provisions of the Zoning
Ordinance loses its status as a nonconforming use by non-use or,
as in the case of this mobile home park, it becomes less
nonconforming with the non-use of one or more spaces . It is my
conclusion that this mobile home park can never have more than 10
spaces even if a public sewer connection is made to it .
If you have any questions about any of this, please call .
Very truly yours,
COL GLEDHILL & HARGRAVE, P.C.
G e E.
