. l <br /> 11 <br /> Exhibit D <br /> AN ACT TO CLARIFY THE AUTHORITY OF ORANGE COUNTY TO REGULATE THE <br /> USE, STORAGE, DISPOSAL, LABELING, OR APPLICATION OF PESTICIDES IN <br /> AREAS SUBJECT TO REGULATION BY THE NORTH CAROLINA PESTICIDE BOARD <br /> IN EXERCISING ITS PLANNING AND ZONING AUTHORITY UNDER ARTICLE 18 <br /> OF CHAPTER 153A OF THE GENERAL STATUTES <br /> The General Assembly of North Carolina enacts : <br /> Section 1 . North Carolina General Statutes § 143-465 (d) is <br /> amended by adding the following sentence to the end thereto: <br /> "Notwithstanding the first sentence of this subsection, <br /> Orange County, in the exercise of its planning and zoning <br /> authority under Article 18 of Chapter 153A of the General <br /> Statutes, may, in a manner more stringent than any rule, <br /> regulation or resolution adopted by the North Carolina <br /> Pesticide Board, regulate the use, storage, disposal, <br /> labeling, or application of pesticides . " <br /> Sec . 2 . This act applies only to Orange County: <br /> Sec. 3 . This act is effective upon ratification. <br /> lsg-8 <br /> pest .exD ` <br />
