The property is located in Chapel Hill Township on the <br /> north side of Eubanks Road (SR 1727) east of Rogers Road(SR 1729) adjacent to the existing landfill <br /> site. <br /> The applicant proposes to construct a 50' x 80' maintenance building on 12.76 acres. The proposed <br /> facility will also include a storage yard for yard waste,mulch, and recyclables. Access to the site will be <br /> through the current landfill site adjacent to the east side of the subject property. <br /> A 100-foot Type F land use buffer is required around the boundary of the zoning lot. A waiver is <br /> requested for the portion of the buffer adjacent to the existing landfill. Article 12.8 of the Zoning <br /> Ordinance allows the Planning Director or his designee to waive the requirements for additional <br /> landscaping in a required land use buffer when strict adherence to the ordinance would serve no useful <br /> purpose. <br /> Given the fact that the maintenance building and storage yard are considered accessory uses to the <br /> adjacent landfill,requiring screening between the lots is not necessary to promote public health, safety or <br /> general welfare. The building setback aspect of the land use buffer is met on the proposed site plan. <br /> In the event another use other than the landfill is proposed on the current landfill site at some point in the <br /> future, and that use is not compatible with the maintenance building and storage yard, it is likely that the <br /> Town of Chapel Hill would require a buffer as part of the site plan approval for a new use on the landfill <br /> site. <br /> The Planning Staff recommends approval of the waiver of additional planting requirements along the <br /> eastern lot line because the current adjacent land use is compatible,that is, similar in function and <br /> character. <br />
