Access to the site will be provided through the existing landfill. There will be no <br /> direct access to Eubanks Road. <br /> A 100-foot buffer will be provided around the perimeter of the site, except along <br /> the eastern border, next to the existing landfill. The Chapel Hill Planning <br /> Department indicated concern with landscaping on the property. The Orange <br /> County Planning Staff inspected the property and found all landscape standards <br /> are met. The wooded area along Eubanks Road has been shown on the site plan. <br /> Vegetation will not be disturbed as the building construction area will be <br /> approximately 90 feet away. A condition of approval has also been added to <br /> insure that all vegetation within the 100 foot buffer will remain undisturbed. In <br /> the 100 foot buffer along the western property line(referred to as internal buffer <br /> areas in the Chapel Hill letter)there are young mixed hardwoods approximately 6 <br /> feet in height that meet the landscaping buffer requirements. Land within the <br /> designated storage area for yard waste,mulch and recyclables will be seeded, <br /> repaired and maintained. <br /> The hours of operation of the site will be from 7:00 a.m. to 4:00 p.m. Monday <br /> through Friday, and 8:30 a.m. to 12:00 noon'on Saturday. <br /> RECOMMENDATION: Article 8.4.3 of the Zoning Ordinance requires that the Zoning Officer's <br /> recommendation be presented to the Planning Board within 45 days of receipt of <br /> an application. The 45-day period may be extended up to 60 days with the written <br /> consent of the applicant. The public hearing is the time scheduled for presentation <br /> of the Zoning Officer's recommendation. <br /> Zoning Off'icer's Recommendation <br /> The Zoning Officer has not received information which would establish grounds <br /> for making a negative finding on the general standards. These standards include <br /> maintaining or promoting the public health,safety, and general welfare, <br /> maintaining or enhancing the value of contiguous property, and the use being in <br /> compliance with the general plan for the physical development of the County. <br /> The Zoning Officer has reviewed the application, the site plan and all supporting <br /> documentation and has found that the application does comply with the specific <br /> standards and required regulations concerning the modification. <br /> Provided the Planning Board and County Commissioners find in the affirmative <br /> on the general standards, the Zoning Officer recommends approval of the request <br /> for a Special Use Permit for the Orange Regional Landfill subject to the following <br /> conditions: <br />
