Brough AW <br /> DATE: December 19, 1996 <br /> RE: Special Legislation <br /> As the Board is aware, the "long session" of the General Assembly will <br /> begin in January, with an expected deadline for the introduction of local bills <br /> sometime in mid March. In considering the possibility of local legislation for <br /> the Town of Carrboro, three matters have come to my attention, and I have drafted <br /> the attached bill to deal with two of them. <br /> First, the Town Charter presently requires that a quorum consisting of at <br /> least six members must be present before the Board of Adjustment can act. The <br /> land use ordinance, however, only requires a quorum of four members. To resolve <br /> this conflict, I suggest that the charter be amended to eliminate the mandatory <br /> quorum of six members, and the attached draft accomplishes this result. <br /> Second, the administration has requested that I prepare a draft of a <br /> charter amendment that would authorize the Town to adopt an ordinance requiring <br /> sprinklers to be established in newly constructed multi-family residences. The <br /> existing Town charter already authorizes the Town to require sprinklers in <br /> buildings in excess of 50' in height, non-residential buildings in excess of <br /> 5,000 square feet, and non-residential buildings used for assembly occupancies. <br /> However, the charter does not contain authority to require that multi-family <br /> residences that do not exceed 501 in height be equipped with sprinkler systems. <br /> The attached amendment provides this authority. <br /> Finally, under separate cover we are sending the Board a memo dealing with <br /> the Issue of inclusionary zoning. Depending upon what the Board's response is <br /> to this issue, special legislation may be necessary. <br /> I would be happy to respond to any questions the Board may have about any <br /> of these matters and to draft any other special legislation that the Board may <br /> request. <br /> Carr-t8.nwa <br />
