c U �f_ <br /> WATER AND SEWER SERVICES BOUNDARY TASK FORCE <br /> NOVEMBER 6, 1996 <br /> MINUTES <br /> A meeting of the Public Water and Sewer Services Boundary Task Force was <br /> held on Wednesday, November 6, 1996 at 7:30 p.m. in the OWASA Community <br /> Meeting Room, Carrboro, North Carolina. <br /> MEMBERS PRESENT: Orange County Board of Commissioners Moses Carey, Jr. and <br /> Alice Gordon, Chapel Hill Town Council Joe Capowski, Carrboro Board of Aldermen <br /> Jay Bryan, OWASA Board of Directors Pat Davis and Barry Jacobs. <br /> MEMBERS ABSENT: Chapel Hill Town Council Julie Andresen, Carrboro Board of <br /> Aldermen Hilliard Caldwell, Hillsborough Town Commissioner Evelyn Lloyd. <br /> MINUTES: The minutes of the September 4, 1996 meeting were approved, with <br /> changes, by consensus. <br /> ATTORNEY REVIEW OF CONCEPTUAL DRAFT WATER AND SEWER SERVICE <br /> .BOUNDARY AGREEMENT: <br /> County Attorney Geoff Gledhill reviewed the letter dated November 5, 1996 in <br /> which attorneys Michael Bough, Robert Epting, Geoffrey Gledhill and Ralph Karpinos <br /> reviewed this Draft Agreement. A copy of that letter was distributed to each member. It <br /> is made a permanent part of this record, by reference, and is in the Water and Sewer <br /> Boundary Task force file in the Clerk's office. He indicated that any attempt to direct <br /> growth through this agreement would be considered land use planning. For example, <br /> the section which refers to the OWASA long-term Interest Area indicates that public <br /> water and sewer would generally be prohibited in this area. The attorney's consider this <br /> type of statement to be land use planning, therefore, this concept should be in the Joint <br /> Area Planning document rather that this Agreement. <br /> Pat Davis stated that the intent here was to claify current policy, not to set that <br /> policy. <br /> Jay Bryan asked for clarification regarding the legal prohibitions for including <br /> land use references in this document. <br /> Geoff Gledhill indicated that in the view of the attorneys involved these directives <br /> are planning directives and must be handled as such with the agreement of the all of <br /> the elected boards. <br /> Barry Jacobs commented that the intent was that people would be clear about <br /> where water and sewer was to be extended. He felt that if the attorneys saw this as <br /> muddying the water he was fine with deleting it. <br />
