1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date: June 18, 2013 <br /> Action Agenda <br /> Item No. 5-t <br /> SUBJECT: Land Lease for Orange County Jail <br /> DEPARTMENT: County Manager, County PUBLIC HEARING: (Y/N) No <br /> Attorney, Asset Management <br /> Services <br /> ATTACHMENT(S): INFORMATION CONTACT: <br /> 1) Council of State Approval Frank Clifton, 919-245-2306 <br /> 2) Aerial Locator John Roberts, 919-245-2318 <br /> 3) Strikethrough Version of Jail Jeff Thompson, 919-245-2658 <br /> Ground Lease Agreement <br /> PURPOSE: To: <br /> 1) Enter into a fifty year Land lease Agreement with the State of North Carolina for an <br /> estimated 8.53 acre parcel located near the existing Orange Corrections Facility at a rate <br /> of $1 per year for the purpose of the development and construction of a County Jail <br /> facility; and <br /> 2) Authorize the Chair, upon final approval of the County Attorney, to sign the Land Lease <br /> Agreement on behalf of the Board of County Commissioners. <br /> BACKGROUND: In October 2012, the North Carolina Council of State ("COS") approved a <br /> Land Lease with Orange County for the purpose of a permanent Orange County jail facility. <br /> Attachment 1, entitled "Council of State Approval", outlines the terms of the COS approval. <br /> Attachment 2, "Aerial Locator' illustrates the location adjacent to the Orange Correctional Center <br /> managed by the State. This arrangement provides adequate space for a facility that may <br /> accommodate up to 250 inmates and allows the existing jail facility to be re-purposed for other <br /> uses. <br /> The North Carolina Department of Administration's Property Office has worked closely with <br /> County staff, the North Carolina Department of Corrections, and the North Carolina Attorney <br /> General's office to craft an acceptable Lease Agreement (Attachment 3, "Lease Agreement"). <br /> The consideration for the 50 year term of the Land Lease is $1.00 per year. The County will <br /> provide for all development, design, construction and operations for the facility throughout the <br /> term. At the end of the 50 year term, the County may choose to approach the Council of State <br /> for a renewal of the Lease that is in the County's best interest. <br /> The Lease contemplates the completion and operation of the facility in no more than 72 months <br /> from the Effective Date of the Lease.
