K <br />Section 7 of the Schools Adequate Public Facilities Memorandum of Understanding (MOU) <br />states, "Orange County will use its best efforts to provide the funding to carry out the Capital <br />Improvement Plan referenced in Section 1 above." <br />Neither Orange County Planning nor non - departmental budgets have added any contractual <br />services monies for re- analysis of student generation rates or school impact fees. The final <br />phase of a 4 -year school impact fee escalation concluded on January 1, 2012 (fee schedule <br />at: http: / /orangecountync.gov /planning /PDFs/ fees /School %20Impact %20Fees.pdf). These fees <br />reflected an approximate 60% recuperation of actual costs to provide for `student stations' <br />based on a 2007 -08 consultant study. SAPFOTAC partners have discussed the desirability of a <br />new study to ensure the data and fees are kept up -to -date but, due to budget constraints, a new <br />study has not been funded. <br />RECOMMENDATION(S): The Manager recommends the Board approve the 2013 <br />SAPFOTAC Annual Report and certify those aspects of the Report detailed in the summary <br />table above. <br />
