24 <br /> 1 clearly lay out the "opt out"provisions in the contract; for the County to agree to work <br /> 2 collaboratively with the Town to explore ways to equitably provide and fund services to <br /> 3 residents in and around ETJ areas over the next 2 years, and to ask staff to come back with <br /> 4 suggestions to how to effectively implement this; to establish a public hearing, after the Town of <br /> 5 Chapel Hill has discussed this recommendation, to consider the establishment of the three new <br /> 6 Fire Service Districts - the South Orange Fire Service District, the North Chatham Fire Service <br /> 7 District and the Greater Chapel Hill Fire Service District. <br /> 8 <br /> 9 Commissioner McKee asked what equitable service provision meant. <br /> 10 Commissioner Dorosin said that services are provided at equitable levels and costs. <br /> 11 Commissioner McKee clarified that they are asking for a specific time and cost and <br /> 12 service. Commissioner McKee asked for Commissioner Dorosin and Commissioner Pelissier to <br /> 13 consider a friendly amendment to take out this last verbiage about equitable services. <br /> 14 Commissioner Dorosin said they need to have this conversation at some point about <br /> 15 how to provide services in all the potential ETJ areas and how those services are equitably <br /> 16 distributed. He said he does not accept the friendly amendment. <br /> 17 Chair Jacobs said the manager's recommendation should be added. <br /> 18 Frank Clifton suggested the county and city staff should do an analysis of services <br /> 19 currently provided within ETJs in all municipalities and the costs associated. <br /> 20 Chair Jacobs said that is a good clarifying point about the motion, but it is not part of the <br /> 21 motion. <br /> 22 <br /> 23 Commissioner Gordon proposed a substitute motion, as follows: <br /> 24 That staff is directed to schedule a public hearing for April 9, 2013 or sooner to consider <br /> 25 the creation of three new fire service districts- the South Orange Fire Service District, the North <br /> 26 Chatham Fire Service District and the Greater Chapel Hill Fire Service District; that staff are <br /> 27 authorized to move forward with a 5 year contract for the Town of Chapel Hill to provide <br /> 28 protection for the proposed new Greater Chapel Hill Fire Service District at a 15 cent tax levy <br /> 29 per one-hundred dollar valuation of real and personal property; that staff is instructed to move <br /> 30 forward to complete the contracts with the other two fire service districts for which contracts <br /> 31 were cancelled; that the agenda item giving the list of steps to create three fire service districts <br /> 32 is brought back to the March 7 Board of Commissioner's meeting to be negotiated and signed, <br /> 33 as well as a target date to complete the entire process of May 21, 2013; and that the Board <br /> 34 work collaboratively with the town of Chapel Hill to address planning and service provision <br /> 35 issues. <br /> 36 <br /> 37 Commissioner McKee seconded this substitute motion. <br /> 38 <br /> 39 John Roberts said the rules of procedure don't recognize substitute motions and require <br /> 40 there to be only one substantive motion at a time. He said this is a hostile motion to amend the <br /> 41 original motion and since it has been seconded, it needs to be voted on. He said if it fails, the <br /> 42 original motion still stands and if it succeeds the original motion is null. <br /> 43 Commissioner Dorosin asked how this motion is different than his, other than the <br /> 44 specific inclusion of a timeline. <br /> 45 Commissioner Gordon said it authorizes the proceeding forward on the other districts <br /> 46 and contracts with the other districts and brings back specific timelines and a checkpoint for <br /> 47 March 7. <br /> 48 Commissioner Dorosin asked if, other than dates, there was any substantive difference. <br />
