Administration Resolution 10 <br /> 3. A stream buffer along McGowan Creek shall be provided in accordance with <br /> r Section 6.23.7 of the Zoning Ordinance. The width of the buffer shall be stated <br /> on the face of plat. Development restrictions within the buffer shall be specified <br /> in a document describing development restrictions and requirements to be <br /> prepared by Planning Staff and recorded concurrently with the Final Plat. <br /> 4. Locate drainage easements on the Final Plat as required by Erosion Control Office <br /> in accordance with review and approval of the Erosion Control Plan. <br /> E. Parkland <br /> 1. See F.5. <br /> F. Miscellaneous <br /> 1. The Final Plat shall contain a title block and vicinity map in accordance with <br /> Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. <br /> 2. The following easements shall be shown on the plat: <br /> a. Drainage easements as required by DA above. <br /> b. Sewer system easements <br /> c. Water system easements <br /> d. Utility easements along right-of-ways. <br /> 3. The minimum building setback requirements and impervious surface maximums <br /> shall be stated on the Final Plat,and in a document describing development <br /> restrictions and requirements to be prepared by Planning Staff and recorded <br /> concurrently with the Final Plat. The impervious surface limitations for each lot <br /> shall indicate the maximum impervious surface for each lot,net of the roadway <br /> (i.e. excluding roadway). <br /> 4. Phasing of the project shall occur only in accordance with the Preliminary Plan. <br /> 5. The entire common area north of Boundbrook Drive(excluding the infiltration <br /> area) and along McGowan Creek shall be dedicated by fee simple deed to Orange <br /> County and referenced on the Final Plat. This dedication shall serve as a <br /> complete payment-in-lieu of parkland dedication. The Homeowner's Association <br /> shall maintain the common area in its present state(dead or diseased trees may be <br /> removed)that is to be deeded to the County until the land is conveyed. <br /> 6. The developer shall grant a 100-foot wide easement to Orange County for the <br /> future installation of a 50-foot wide trail for the purpose of connecting Efland- <br /> Cheeks School with the dedicated property along McGowan Creek. The <br /> Homeowner's Association shall maintain the easement area in its present state <br /> (dead or diseased trees may be removed)until this easement is conveyed to the <br /> County. <br /> 7. All common areas to be owned by Homeowner's Association and shall be <br /> perpetually maintained by the Homeowner's Association. <br /> 8. If any condition of this Resolution shall be held invalid or void, then this <br /> Resolution shall be void in its entirety and of no effect. <br />
