' <br /> / <br /> ~ 9 <br /> 3^ - It will comply by: <br /> ' <br /> (s) publishing a statement notifying employees that the unlawful manufacture, distribution, <br /> dispensing, possession or use of a controlled substance is prohibited |n the grantee's <br /> vvork»|ace and specifying the actions that will be taken against employees for violation of <br /> such prohibition; ' <br /> - <br /> (b) establishing a drug-free awareness program to inform employees about - <br /> (1) the dangers of drug abuse in the workplace; <br /> . (2) the grantee's policy ofmaintaining adruQ-froe workplace; <br /> (3) any available drug counseling, rehabilitation, and employee assistance programs; <br /> and' <br /> (4) the penalties that may be imposed upon employees for drug abuse violations <br /> occurring in the workplace; <br /> ` <br /> (c) making it a requirement that each employee to be engaged in the perfornlonoe of the grant <br /> be given m copy mf the-statement required by paragraph (e) above; <br /> (d) notifying the employee in the statement required by paragraph (a) above, that as a <br /> condition of.employment under the grant, the annp/oyaa will - <br /> (1) 'abide 6v the terms of the statement; and <br /> (2) nptify.tho employer of any criminal drug statute conviction for a violation occurring <br /> in the workplace no later than five days after such conviction; <br /> (a) :notifying the.agency within ten days after rece iving notice under subparagraph (d) (2) <br /> above, from an employee or otherwise receiving actual notice of such conviction; <br /> OD taking one of the-following actions within 3O days of receiving notice under subparagraph <br /> (d) (2) above, with respect to any employee who ismo convicted - <br /> (1) taking oppropribie personnel action against such onemployee, upto and including <br /> termination; or <br /> (2) requiring such employee to participate satisfactorily in a drug abuse assistance or <br /> rehabilitation program approved for such purposes by a Federal, State, or local <br /> health, /avv enforcement, or other appropriate agency; <br /> (o) making o good faith effort to continue tomaintain adruQ-free workplace thruuoh <br /> implementation of paragraphs (a), (b), (o), (d), (a), and (f), above. <br /> AND <br /> 4. Will comply with the provisions of the Hatch Ant which limit the po|idom\ activities of employees <br /> whose principal employment activities are funded in whole orin part with Federal funds. <br /> 5. VNU comply, as applicable, with the provisions of the Davis-Bacon Act the Copeland /\ot and the <br /> Contract Work Hours and Safety Standards Act regarding labor standards for federally assisted <br /> conntructionaubagreenmento' <br /> 6.
