a) Where it is determined that the one (1) year grace period shall <br /> not apply,the Planning Director or Designee shall determine the <br /> time within the connection shall be removed. In setting the time <br /> limit for compliance,the County shall take into consideration: <br /> (1) The quantity and complexity of the work. <br /> (2) The consequences of delay. <br /> (3) The potential harm to the environment,to the public <br /> health,to public and private property,to wildlife, and to <br /> natural resources. <br /> (4) The cost of remedying the damage. <br /> E. Spills <br /> Spills or leaks of polluting substances discharged to, or having the potential to <br /> reach the stormwater collection system, shall be contained, controlled, collected, <br /> and removed promptly. All affected areas shall be restored to their preexisting <br /> condition. <br /> 1. Notification of Spills <br /> a) Notwithstanding other requirements of law, as soon as any <br /> person responsible for a facility or operation, or responsible for <br /> emergency response for a facility or operation has information of <br /> any known or suspected release of materials which are resulting or <br /> may result in illegal discharges or pollutants discharging into or <br /> may reach the stormwater collection system or waters of the Neuse <br /> River Basin in Orange County, said person shall take all necessary <br /> steps to ensure the discovery, containment, and cleanup of such <br /> discharge. In the event of such a discharge of hazardous materials, <br /> said person shall immediately notify emergency response agencies <br /> of the occurrence via emergency dispatch services, and shall notify <br /> the County within twenty-four(24)hours. In the event of a <br /> discharge of non-hazardous materials, said person shall notify the <br /> County no later than the next business day. All notifications shall <br /> be confirmed by written notice addressed and mailed to the County <br /> within three(3)business days of the discharge. <br /> b) Notification shall not relieve said person of: <br /> (1) any liability or expense related to the discharge. <br /> (2) restoration of any area affected by the discharge to <br /> preexisting conditions. <br /> (3) liability or violation of any regulatory body of the <br /> County, State or Federal government. <br /> Section 15 Inspections and Investigations <br /> A. Site Inspections <br /> Agents, officials, or other qualified persons authorized by the County will <br /> periodically inspect on-site BMP's and illegal discharges to ensure: <br /> 32 <br />
