that are due may not be assigned without such consent(except to the extent that the effect of <br /> this restriction may be limited by law), and unless specifically stated to the contrary in any <br /> written consent to an assignment, no assignment will release or discharge the assignor from <br /> any duty or responsibility under the Contract Documents. <br /> 9.3. COUNTY and CONTRACTOR each binds itself, its partners, successors, assigns and legal <br /> representatives to the other party hereto, its partners, successors, assigns and legal <br /> representative in respect of all covenants, agreements and obligations contained in the <br /> Contract Documents. <br /> 9.4 The CONTRACTOR shall furnish the COUNTY certified statements setting for the cost of <br /> the materials purchased from each vendor and the amount of North Carolina sales and use <br /> taxes paid thereon. In the event the CONTRACTOR makes several purchases from the <br /> same vendor, such certified statement shall indicate the invoice number, the inclusive date <br /> of the invoices, the total amount of the invoices, and the North Carolina sales and use taxes <br /> paid thereon. Such statement shall also include the cost of any tangible personal property <br /> withdrawn from the CONTRACTOR'S warehouse stock and the amount of North Carolina <br /> sales or use tax paid thereon by the CONTRACTOR. The CONTRACTOR shall furnish <br /> such additional information as the commissioner of Revenue of the State of North Carolina <br /> may require to substantiate a refund claim of the COUNTY for sales or use taxes. The <br /> CONTRACTOR shall obtain and furnish to the COUNTY similar certified statements by <br /> the subcontractors. The certified statements to be furnished shall be in the form of the <br /> standard CONTRACTOR'S SALES TAX REPORT and shall be submitted with each <br /> request for payment. The COUNTY shall not make payments to the CONTRACTOR until <br /> the required CONTRACTORS Sales Tax Reports are submitted. The CONTRACTOR <br /> shall not be entitled to any portion of the refund received by the COUNTY from the State <br /> for sales and use taxes. <br /> Article 10 OTHER PROVISIONS <br /> IN WITNESS WHEREOF, COUNTY AND CONTRACTOR have signed four (4) copies of this <br /> Agreement in triplicate. One counterpart each has been delivered to COUNTY, CONTRACTOR <br /> and ENGINEER.
