AGREEMENT Between UNC School of Medicine <br /> and Orange County Health Department <br /> Page 8 of 9 <br /> beyond those appropriated in the sole discretion of Orange County <br /> or OCHD for any fiscal year in which this Agreement shall be in <br /> effect. No deficiency judgment may be rendered against Orange <br /> County or OCHD in any action for breach of a contractual <br /> obligation under this Agreement and the taxing power of Orange <br /> County or OCHD is not and may not be pledged directly or <br /> indirectly or contingently to secure any moneys due under this <br /> Agreement. <br /> 21 . With regard to the services to be performed pursuant to this <br /> Agreement by the University it is hereby covenanted and agreed <br /> that OCHD shall not make any use whatsoever of the name of The <br /> University of North Carolina at Chapel Hill or any of the <br /> colleges or schools or departments contained therein in any <br /> campaign of advertising or in any manner whatsoever, without the <br /> express written permission of The University, which permission <br /> shall not be unreasonably withheld, unless compelled to divulge <br /> said name by force of law. It is also agreed that OCHD shall not <br /> attempt to circumvent the intent of this paragraph by the use of <br /> descriptive phrases by which one could identify The University <br /> with reasonable certainty. <br /> 22 . This Agreement contains the entire understanding of the parties <br /> and shall not be altered, amended, or modified, except by an <br /> agreement in writing executed by the duly authorized officials of <br /> both parties . <br />
