.ZD /.?, p G L <br /> 140 C- <br /> NORTH CAROLINA <br /> ORANGE COUNTY <br /> AMENDMENT TO DEVELOPMENT AGRE�E,MENT <br /> THIS AMENDMENT, made and entered into this the °� day of January, 2013 by and <br /> between ORANGE COUNTY, a general local governmental unit of the State of North Carolina, <br /> (hereinafter referred to as the "County") and HOUSING FOR NEW HOPE, INC, a North <br /> Carolina non-profit housing organization (hereinafter referred to as "Provider") (both <br /> collectively referred to as the"Parties"). <br /> WITNESSTH <br /> WHEREAS, the County and Provider entered into a "Development Agreement' <br /> ("Original Agreement'), dated April 13, 2010 in which the County on behalf of the Orange <br /> County HOME Consortium designated FY 2009 HOME funds to Owner to provide tenant-based <br /> rental assistance to homeless individuals and families transitioning to permanent housing in <br /> Orange County; and <br /> WHEREAS, the Orange County HOME Consortium has designated approximately <br /> $50,000 in FY 2012 HOME funds to provide tenant-based rental assistance to homeless <br /> individuals and families transitioning to permanent housing in Orange County; and <br /> WHEREAS, the County and Provider desire to amend the Original Agreement, while <br /> keeping in effect all terms and conditions of the Original Agreement not inconsistent with the <br /> terms and conditions set forth below. <br /> NOW THEREFORE, for and in consideration of the mutual covenants and agreements <br /> made herein, the Parties agree to amend the following sections of the Original Agreement as <br /> follows: <br /> 1. In Section II. Amount of HOME Funds/Form of Subsidy amend as follows: <br /> The County shall make available to the Provider up to One Hundred Thousand <br /> Dollars ($100,000) pursuant to this Agreement. Said funds shall be disbursed by the <br /> County to the Provider for performance of services described in Exhibit B. Home <br /> Program subsidy will be provided as a grant to each identified family as a fixed <br /> subsidy by payment to the landlord or utility company. <br /> 2. Exhibit B: Project Budget shall be amended to add funding for FY 2011-12 and FY <br /> 2012-13 as follows: <br /> 1 <br />
