AN ORDINANCE APPROVING AN ORANGE COUNTY BOARD OF HEALTH RULE <br /> PROHIBITING SMOKING IN COUNTY AND TOWN BUILDINGS, GROUNDS, VEHICLES, AND <br /> PUBLIC PLACES <br /> WHEREAS, in 2009 the North Carolina General Assembly enacted Session Law 2009-27, <br /> which authorized local governments and local boards of health to prohibit smoking in certain <br /> areas; and <br /> WHEREAS, rules adopted by local boards of health are generally applicable throughout the <br /> county of adoption including within town jurisdictions; and <br /> WHEREAS, on October 24, 2012 the Orange County Board of Health adopted a rule <br /> (Attached hereto as Exhibit 1) prohibiting smoking in County and Town buildings, grounds, <br /> vehicles, and public places; and <br /> WHEREAS, the Commissioners of Orange County, believing it to be in the best interest of the <br /> citizens and residents of Orange County, have determined that the rule by the Orange County <br /> Board of Health prohibiting smoking throughout Orange County is approved. <br /> NOW THEREFORE BE IT ORDAINED, by the Orange County Board of Commissioners that <br /> the Orange County Board of Health Rule prohibiting smoking in county and town buildings, <br /> grounds, vehicles, and public places is approved. <br /> A motion was made by Commissioner Yuhasz, seconded by Commissioner Hemminger <br /> to approve by Ordinance, of the Orange County Board of Health's Smoke Free Public Places <br /> Rule adopted by the Board of Health on October 24, 2012 and authorize the Chair to sign. <br /> VOTE: Ayes, 6; No, 1 (Commissioner McKee) <br /> Commissioner McKee said that he sees this as government overreach. He supports <br /> funding additional educational efforts. He sees this as an overreach on private properties. <br /> Commissioner Jacobs said that he is pleased the County Commissioners are doing this <br /> and he feels that this is in correlation with the values they hold dear in Orange County. <br /> b. Class A Special Use Permit Major Subdivision — Dunhill (Weekly Homes <br /> LLC) — Public Hearing Closure and Action (No Additional Comments from the Public or <br /> Applicant Accepted) <br /> The Board received the Planning Board recommendation, considered closing the public <br /> hearing, and making a decision on a Class A Special Use Permit application submitted by <br /> David Weekly Homes LLC proposing a 26 lot single-family residential development off of Mt <br /> Sinai Road in accordance with the provisions of Section(s) 2.7 and 5.15.6 of the Unified <br /> Development Ordinance (UDO). <br /> This item was transcribed verbatim as is required for a Class A Special Use Permit. <br />
