6 <br /> 1 it is brought back to them next year, to get a report describing the residency of those <br /> 2 who receive adult day care services during the period of October 2012 to September <br /> 3 2013. <br /> 4 <br /> 5 Commissioner Gordon made the following recommendation <br /> 6 <br /> 7 Agenda Item 7-a, Senior Care of Orange County, Inc. - Revised By-Laws and Lease <br /> 8 Agreement <br /> 9 <br /> 10 At their Nov. 20, 2012 BOCC meeting, the Commissioners noted that the lease <br /> 11 agreement had no provision specifying that the adult day care services offered by <br /> 12 Senior Care should serve Orange County residents, even though the lease amount was <br /> 13 going to be $1 per year. The Commissioners requested information concerning <br /> 14 whether the lease could be changed to add that provision. <br /> 15 <br /> 16 The agenda materials state that Department on Aging Director Janice Tyler indicated <br /> 17 that it is certainly acceptable to ask that Senior Care's first priority be to serve the <br /> 18 residents of Orange County. <br /> 19 <br /> 20 Therefore I will be recommending at the December 3 BOCC meeting that the following <br /> 21 motion be adopted. <br /> 22 <br /> 23 MOTION <br /> 24 A. By-Laws <br /> 25 Approve the revised by-laws as written. <br /> 26 <br /> 27 B. Resolution <br /> 28 (1 ) Amend the resolution to add the following "Whereas" statement between <br /> 29 the current third and fourth "Whereas" statements: <br /> 30 <br /> 31 "Whereas, Senior Care's first priority for the Adult Day Health Center should be to <br /> 32 provide services to Orange County residents;" <br /> 33 <br /> 34 (2) Adopt the amended resolution. <br /> 35 <br /> 36 C. Lease Agreement <br /> 37 (1 ) Amend the lease agreement to add the following sentence at the end of section 3 <br /> 38 (Term and Rental), paragraph (c): <br /> 39 <br /> 40 "Tenant acknowledges that the Tenant's first priority for the Adult Day Health Center is <br /> 41 to provide services to Orange County residents." <br /> 42 <br /> 43 (2) Approve the amended lease agreement. <br /> 44 <br /> 45 C. Signature <br /> 46 Authorize the Chair to sign the amended resolution and amended lease agreement. <br />
