29 <br /> 1 12. No hazardous materials shall be stored on the property. <br /> 2 <br /> 3 The applicant shall include this prohibition within storage unit lease documents <br /> 4 informing clients of the prohibition. <br /> 5 <br /> 6 13. All required landscaping, as denoted on the site plan, shall be installed prior to the <br /> 7 issuance of a Certificate of Occupancy allowing for the units to be rented/occupied. <br /> 8 14. The applicant shall contract with a private solid waste contractor to remove trash <br /> 9 from the site consistent with the submitted site plan and in accordance with the <br /> 10 Orange County Solid Waste Management Ordinance. <br /> 11 <br /> 12 Commissioner Yuhasz asked about condition 2 and said that it is not tied to any specific <br /> 13 development activity. <br /> 14 <br /> 15 Michael Harvey suggested that when making the motion to revise condition 2 that staff <br /> 16 record the final agreement within 90 days from approval. <br /> 17 John Roberts asked Mr. Chandler if he was ok with the condition and he said yes. <br /> 18 Commissioner Jacobs made reference to condition #13 and landscaping. He said that <br /> 19 the accepted build out for Phase I did not have landscaping. <br /> 20 Michael Harvey said that if the site plan is approved then the landscaping has to be <br /> 21 installed as construction commences consistent with this approval. <br /> 22 Commissioner Jacobs said that staff was good enough to provide the information that <br /> 23 was requested. He made reference to page 61 and said that he cannot tell about the buffer on <br /> 24 this page or on page 54. <br /> 25 Michael Harvey said that on page 61 there is a continuous buffer. Regarding page 54, <br /> 26 this is an intermittent buffer. <br /> 27 Commissioner McKee made reference to page 54 and said that a buffer will be much <br /> 28 smaller when it is planted. <br /> 29 <br /> 30 A motion was made by Commissioner Hemminger, seconded by Commissioner McKee <br /> 31 to close the public hearing. <br /> 32 VOTE: UNANIMOUS <br /> 33 <br /> 34 A motion was made by Commissioner Yuhasz, seconded by Commissioner Hemminger <br /> 35 to amend condition 2 to read as follows: <br /> 36 "Staff shall prepare a `Declaration of Development Restrictions and requirements' upon <br /> 37 the approval of this conditional use and that such declaration shall be recorded at the Orange <br /> 38 County Registrar of Deeds office prior to commencement of construction activity. <br /> 39 VOTE: UNANIMOUS <br /> 40 <br /> 41 A motion was made by Commissioner McKee, seconded by Commissioner Hemminger <br /> 42 to approve, with the amended language for condition 2, the Ordinance Amending the Orange <br /> 43 County Zoning Atlas, including the imposition of recommended conditions, as contained within <br /> 44 Attachment 8. <br /> 45 <br /> 46 Commissioner Hemminger said that she wants this project to move forward but she still <br /> 47 has concerns about the well. <br /> 48 Commissioner Gordon said that she would like to amend the motion to revise condition <br /> 49 3 to have a well built at the beginning of Phase 1 rather than the end. <br />
