16 <br /> 1 WHEREAS, on October 24, 2012 the Orange County Board of Health adopted a rule (Attached <br /> 2 hereto as Exhibit 1) prohibiting smoking in County and Town buildings, grounds, vehicles, and <br /> 3 public places; and <br /> 4 <br /> 5 WHEREAS, the Commissioners of Orange County, believing it to be in the best interest of the <br /> 6 citizens and residents of Orange County, have determined that the rule by the Orange County <br /> 7 Board of Health prohibiting smoking throughout Orange County is approved. <br /> 8 <br /> 9 NOW THEREFORE BE IT ORDAINED, by the Orange County Board of Commissioners that <br /> 10 the Orange County Board of Health Rule prohibiting smoking in county and town buildings, <br /> 11 grounds, vehicles, and public places is approved. <br /> 12 <br /> 13 <br /> 14 A motion was made by Commissioner Yuhasz, seconded by Commissioner Hemminger <br /> 15 to approve by Ordinance, of the Orange County Board of Health's Smoke Free Public Places <br /> 16 Rule adopted by the Board of Health on October 24, 2012 and authorize the Chair to sign. <br /> 17 VOTE: Ayes, 6; No, 1 (Commissioner McKee) <br /> 18 <br /> 19 Commissioner McKee said that he sees this as government overreach. He supports <br /> 20 funding additional educational efforts. He sees this as an overreach on private properties. <br /> 21 <br /> 22 Commissioner Jacobs said that he is pleased the County Commissioners are doing this <br /> 23 and he feels that this is in correlation with the values they hold dear in Orange County. <br /> 24 <br /> 25 <br /> 26 b. Class A Special Use Permit Major Subdivision — Dunhill (Weekly Homes <br /> 27 LLC) — Public Hearing Closure and Action (No Additional Comments from the Public or <br /> 28 Applicant Accepted) <br /> 29 The Board received the Planning Board recommendation, considered closing the public <br /> 30 hearing, and making a decision on a Class A Special Use Permit application submitted by David <br /> 31 Weekly Homes LLC proposing a 26 lot single-family residential development off of Mt Sinai <br /> 32 Road in accordance with the provisions of Section(s) 2.7 and 5.15.6 of the Unified Development <br /> 33 Ordinance (UDO). <br /> 34 <br /> 35 This item was transcribed verbatim as is required for a Class A Special Use Permit. <br /> 36 <br /> 37 Michael Harvey: This is a Class A Special Use Permit request for a major subdivision on Mt. <br /> 38 Sinai Road.
