NOTICE OF JOINT PUBLIC HEARING <br />ORANGE COUNTY BOARD OF COMMISSIONERS <br />ORANGE COUNTY PLANNING BOARD <br />A joint public hearing will be held at the Department of Social Services, Hillsborough <br />Commons, 113 Mayo St., Hillsborough, North Carolina, on Monday, February 25, 2013 <br />at 7:00 PM for the purpose of giving all interested citizens an opportunity to speak for or <br />against the following items: <br />Unified DevelopmentOrdinance (UDO) Text Amendment: <br />1.In accordance with <br />the provisions of Section 2.8 Zoning Atlas and Unified Development Ordinance <br />Amendmentsof the Unified Development Ordinance, the Planning Director has <br />initiated an amendment to the text of the Unified Development Ordinance (UDO). <br />Text amendments are proposed to Section(s) 2.4.1 Zoning CompliancePermits – <br />Applicability, 2.5.3 Plan Specifications, and 7.6.3 Land Suitability. <br />In April of 2012 the County modified the UDO to adoptStaterequiredstormwater <br />management standards. This included adoption of land disturbance thresholds <br />requiring the submittal of formal, professionally prepared,stormwater <br />management and erosion control plans. <br />The purpose of thisamendment isto modify existing language to provide <br />additional reference to these thresholds in an effort to avoid requiring project <br />applicantsto submitmultiple, professionally prepared, plans for asingle <br />development project. <br />Purpose: To review the item and receive public comment on the proposed <br />amendment. <br />Unified Development Ordinance (UDO) Text Amendment <br />2.: In accordance with <br />the provisions of Section 2.8 Zoning Atlas and Unified Development Ordinance <br />Amendmentsof the Unified Development Ordinance, the Planning Director has <br />initiated an amendment to the text of the Unified Development Ordinance(UDO). <br />Text amendments are proposed to Section(s)2.14.1 Review and Decision <br />Process Flow Chart – Minor Subdivisions, 2.15.5 Certificate of Adequacy of <br />Public School Facilities, 6.19 Adequate Public Facilities: Schools, and Section <br />7.14.3 (F) (3) (g) Final Plat Specifications. <br />The purpose of the amendments is to ensure County regulations and procedures <br />are compliant with recent North Carolina case law. Specifically, the amendment <br />will remove the Certificate of Adequate Public Schools(CAPS) denial provision <br />as part of the development approval process when schoolcapacity is exceeded. <br /> <br />
