If the Board of County Commissioners does not so <br />direct, the Planning Board shall make its recommendation within three regularly <br />scheduled Planning Board meetings. <br />(C) If the Planning Board fails to make a recommendation within the time allotted in <br />subsection (B) above, the application shall be forwarded to the Board of County <br />Commissioners without a Planning Board recommendation. <br />(D) Amendments initiated by Orange County shall not be subject to time limitations other <br />than those specified by the Board of County Commissioners during the public hearing <br />process. <br />(E) Evidence not presented at the public hearing may be submitted in writing to the Planning <br />Board for consideration prior to the Planning Board's recommendation to the Board of <br />County Commissioners. The Planning Board may consider additional oral evidence only <br />if it is for the purpose of presenting information also submitted in writing. <br />2.8.9 Action by Board of County Commissioners <br />(A) The Board of County Commissioners shall not consider enactment of the proposed <br />amendment until the Planning Board either makes its recommendation or takes no action <br />on the application as prescribed in Section 2.8.8(C). <br />(B) In making its decision, the Board of Commissioners shall consider all relevant evidence <br />presented at the public hearing and any submitted written evidence that was considered <br />by the Planning Board in making its recommendation. <br />2.8.10 Text Revisions Pertaining to Soil Erosion and Sedimentation Control Provisions <br />(A) The Erosion Control Officer shall review all of the North Carolina Sedimentation Control <br />Commission's revisions to the State's Model Soil Erosions and Sedimentation Control <br />Ordinance and, within 90 days of receipt of the recommended revisions, submit draft <br />amendments to the North Carolina Sedimentation Control Commission for its <br />consideration and comments. <br />(B) Within 150 days after receipt of the North Carolina Sedimentation Control Commission's <br />comments, Orange County shall formally consider proposed amendments and, to the <br />extent deemed necessary by the Board of County Commissioners, incorporate the <br />amendments into this Ordinance. <br />(C) Text amendments to this Ordinance for soil erosion and sedimentation control provisions <br />shall comply with the requirements in effect for any other text amendment. <br />2.8.11 Text Revisions Pertaining to Stormwater Provisions <br />(A) The Erosion Control Officer shall review all of the State Environmental Management <br />Commission's revisions to the State's Model Stormwater Ordinance and, within 90 days <br />statutes require that notice be mailed via first -class mail while Orange County requires that notices for non - County <br />initiated amendments be mailed via certified mail. <br />Orange County, North Carolina — Unified Development Ordinance Page 2 -24 <br />
