3 <br /> Resolution <br /> Relative to Efland Sewer System Facilities <br /> On or Across Properties Owned or Controlled <br /> by <br /> Barber & Ross Company, the North Carolina Railroad Company <br /> and <br /> Norfolk Southern Railway Company <br /> WHEREAS, Barber & Ross Company approached Orange County about <br /> opening a new millwork plant in the unused Redman Mobile <br /> Home building and serving that facility by an extension of <br /> the Efland sewer system; and <br /> WHEREAS, Orange County agreed to allow Barber & Ross Company to <br /> construct a force main type extension of the Efland sewer <br /> system to provide sewer service to the Barber & Ross <br /> Company facility; and <br /> WHEREAS, extension of the Efland sewer system to serve the <br /> Barber & Ross Company facility entailed installing portions <br /> of the sewer force main in public -! NCDOT and the North <br /> Carolina Railroad Company/Norfolk Southern Railway Company <br /> - rights-of-way; and <br /> WHEREAS, NCDOT and railroad companies typically require that <br /> water and sewer utilities installed within their respective <br /> rights-of-way be owned and operated by a public utility or <br /> a government agency; and <br /> WHEREAS, orange County agreed to assume ownership of the <br /> portions of the force main system which were to be located <br /> within public - NCDOT and the North Carolina Railroad <br />
