If they chase not to
participate, existing uses can remain, unchanged, as nonconforming land uses (i.e.,
Speedway) or as de facto permitted land uses (i.e., rock quarry operation has an
existing Special Use Permit per Section 11.6 of the Zoning Ordinance)
Conclusions:
• We are still in the beginning stages of this process
• There will be additional involvement by various advisory boards (i.e. Planning Board and
Economic Development Commission}, Task Force members, local residents and
property owners, and our planning partners (i.e. Durham and Person Counties} in
drafting appropriate implementation methodologies.
• This is still intended to be a voluntary process. No property owner will be required to
participate in this program once it is implemented.
• The Speedway can continue to operate as a legal nonconforming land use in
accordance with Article Eleven Nonconformities of the Orange County Zoning
Ordinance.
• The adoption of any implementation methodology for this program WILL NOT have
Countywide implications unless authorized by the BOCC through a similar planning
process.
Commissioner Gordon asked if the land use plan and zoning amendments would be
brought to the same hearing.
