There is, however, no additional site plan review <br /> fee assessed to the applicant. <br /> This is a somewhat unique and new process for the County. The CZ process is intended to <br /> allow open dialogue and negotiation between the applicant and the County on the viability of the <br /> proposed land use and the overall design of a given project. <br /> We are now, technically, in the negotiation phase of the project as the applicant is seeking to <br /> modify existing development criteria staff has determined apply to the project, most notably land <br /> use buffers. Through this negotiation process, additional conditions and recommendations can <br /> be made to address various concerns and finalize the site plan. <br /> As we continue this review, staff will take note of potential procedural modifications designed to <br /> streamline the process, allow for additional opportunity for dialogue amongst the BOCC and the <br /> applicant on the project, and make the process more user friendly for all parties. <br /> Planninq Director's Recommendation: The Planning Director can recommend approval of the <br /> proposed site plan based and the zoning atlas amendment based on the following: <br /> 1. The project is consistent with the goals of the adopted NC Highway 57 Speedway <br /> Area Small Area Plan, <br /> 2. The proposed land use complies with the provisions of Section 5.2.3 of the Orange <br /> County Unified Development Ordinance, <br /> 3. The rezoning is consistent with various Principles, Goals, and Objectives of the <br /> adopted Comprehensive Plan. <br /> 4. Based on the acceptance of design alternatives denoted on the site plan by the <br /> Planning Board and the BOCC, specifically on allowable land use buffers and the <br /> installation of a well on the property, and <br /> FINANCIAL IMPACT: This request has been reviewed by various County departments who <br /> have determined that the approval or denial of the request would not create the need for <br /> additional funding for the provision of County services. <br /> RECOMMENDATION: The Planning Director recommends the Board: <br /> 1. Deliberate as necessary, <br /> 2. Consider the Planning Director's recommendation to: <br /> a. Approve the site plan recommending the imposition of conditions <br /> b. Approve the Ordinance Amending the Orange County Zoning Atlas as contained <br /> within Attachment 4, and <br /> c. Approve the Resolution of Consistency with the Comprehensive Plan as contained <br /> within Attachment 6. <br /> 3. Make a recommendation to the BOCC on the proposal in time for its November 20, 2012 <br /> regular meeting. <br />
