3 <br /> Please refer to Attachment 4 for additional information. The Planning Board voted unanimously to <br /> recommend approval of the rezoning request, the submitted site plan, and the imposition of <br /> conditions for the project consistent with the attached Ordinance (Attachment 8). <br /> Planning Director's Recommendation: The Planning Director recommends approval of this <br /> rezoning based on the following: <br /> A. The rezoning is consistent with the adopted Comprehensive Plan and NC Highway 57 <br /> Speedway Area Small Area Plan. <br /> B. The application has been deemed complete in accordance with the requirements of <br /> Section 2.8 and 2.9.2 of the Unified Development Ordinance (UDO). <br /> C. The proposed use is consistent with Section 5.2.3 Table of Permitted Uses of the UDO. <br /> D. Comments received from various County agencies (i.e. Sheriff, Fire Marshal, <br /> Environment, Agriculture, Parks and Recreation (DEAPR), Orange County Health, State <br /> Clearing House) indicate there are no concerns associated with the request. <br /> E. The property is of sufficient size to support the proposed development. <br /> It should be noted the Planning Board and staff are recommending the imposition of several <br /> conditions. The applicant has agreed to the imposition of these conditions in writing. Please <br /> refer to Attachment 7 for additional detail. <br /> Public Hearing Procedural Information: In accordance with Section 2.7.8 (A) (3) of the UDO, the <br /> BOCC has requested the Planning Board recommendation be made available in time for the <br /> November 20, 2012 BOCC regular meeting. As a procedural note, additional comments on the <br /> application should be submitted in writing prior to the Planning Board meeting in order to <br /> become part of the official record of these proceedings. <br /> FINANCIAL IMPACT: This request has been reviewed by various County departments who <br /> have determined that the approval or denial of the request would not create the need for <br /> additional funding for the provision of County services. <br /> RECOMMENDATION(S): The Manager recommends the Board: <br /> 1. Receive the Planning Board recommendation; <br /> 2. If necessary, deliberate further on the application; <br /> 3. Close the public hearing; and <br /> 4. Take action on the request by: <br /> a. Approving the Ordinance Amending the Orange County Zoning Atlas, including the <br /> imposition of recommended conditions, as contained within Attachment 8; and <br /> b. Approving the Resolution Concerning Statement of Consistency with the <br /> Comprehensive Plan as contained within Attachment 10. <br />
