Approved 11/7/12 92 <br /> MOTION made by Maxecine Mitchell to accept staff findings regarding the projects compliance with Sections 5.3.2(b)of <br /> the LIDO(page 65-66 of the abstract package),Tony Blake seconded. <br /> VOTE:UNANIMOUS <br /> Larry Wright: Let's move to page 67. <br /> MOTION made by Peter Hallenbeck: to find in the affirmative the project complies with the provisions of Section 5.3.2(a) <br /> of the LIDO in that the use will maintain and promote public health safety and general welfare if located where prosed an <br /> developed and the project complies with the provisions of Section 5.3.2 (b) in that the project will maintain or enhance <br /> the value of contiguous property and finally the project is consistent with the requirements of Section 5.3,2(c)specifically <br /> the location and character of the proposed use is in harmony in which it is to be located and the use is in compliance <br /> with the plan for the physical development of the county as embodied in these regulations and the Comprehensive Plan <br /> adopted by the BOCC and there is no evidence entered into the record to the contrary. Maxecine Mitchell seconded. <br /> VOTE:UNANIMOUS <br /> Michael Harvey: With respect to these findings, you are required to include evidence contained within the record <br /> justifying your actions,which can include the letter from Joe Lyle,the broker,the environmental report contained in the <br /> narrative, the applicant's attachment 1, letters from State Department of Cultural Resources memorandum from Health, <br /> Orange County Solid Waste,Transportation Planning, Orange County Erosion Control, Orange County Fire Marshall as <br /> well as the Physical Impact Analysis prepared by staff and entered the record. <br /> Larry Wright: Now we move to the recommendations. <br /> Michael Harvey: On page 73,the board would like to make a statement concerning the connection to the TLC property. <br /> Peter Hallenbeck: On page 73 of the application, number 10, 1 would like to suggest that the change to"no open loop" <br /> geothermal shall be developed within the property for any purpose rather than banning all geothermal wells outright. <br /> Larry Wright: Are there any recommendations about the trail? <br /> MOTION made by Buddy Hartley that the applicant is not required having a trail that connects to the Johnson Mill Nature <br /> Trail and that the recommended condition related to the prohibition of geothermal wells be modified per Pete <br /> Hallenbeck's suggestion. Maxecine Mitchell seconded. <br /> VOTE:UNANIMOUS <br /> Larry Wright: Given these two caveats listed from page 68-73,do I have a motion relative to staffs recommendations? <br /> MOTION made by Maxecine Mitchell to accept the recommendations with the changes. <br /> Tony Blake seconded, <br /> VOTE:UNANIMOUS <br /> 5 <br />
