62 _ <br /> RECOMMENDATION: <br /> Staff has not received any information that would establish grounds for making a negative finding on the general <br /> standards. These standards include maintaining or promoting the public health, safety, and general welfare, <br /> maintaining or enhancing the value of contiguous property, and the use being in compliance with the general plan <br /> for the physical development of the County. <br /> Staff has reviewed the application, the site plan, and all supporting documentation and has found that the <br /> applicant complies with the specific standards and required regulations as outlined within the UDO <br /> Provided the Planning Board finds in the affirmative on the specific and general standards, the Board could make <br /> a positive finding on this application. In the event that the Planning Board makes a recommendation to issue the <br /> permit, Planning Staff recommends the attachment of the following conditions: <br /> A. Development of off-site septic fields: <br /> 1. Only lots 23 through 26 shall be served through an off-site septic system <br /> developed on the parcel denoted on the approved site plan. <br /> 2. Lots 23 through 26 shall have an individual septic systems and repair area on the <br /> designated lot serving as the joint septic area within the project. A combined <br /> system shall not be developed. <br /> 3. The property housing the off-site septic systems shall be maintained by the HOA. <br /> Each individual septic system shall be maintained by the homeowner. Language <br /> governing the maintenance of the lot, as well as the maintenance responsibility for <br /> each septic system, shall be contained within the deeds restrictions and <br /> covenants for the development. <br /> This document shall be reviewed and approved by the County Attorney's office, <br /> Orange County Environmental Health, and the Planning Director prior to <br /> 4. The applicant shall develop an agreement outlining the use, maintenance <br /> responsibility, and liability issues for a proposed easement transferring waste from <br /> lots 23 through 26 to the off-site septic lot. This easement agreement shall be <br /> reviewed and approved by the County Attorney's office, Orange County <br /> Environmental Health, and the Planning Director prior to the recordation of the <br /> final plat. <br /> 5. The applicant shall execute a utility extension and installation agreement <br /> consistent with the aforementioned easement agreement covering the extension <br /> of sewer lines from lots 23 through 26 to the off-site septic lot. This agreement <br /> shall be prepared by the applicant and reviewed by the Orange County Staff <br /> Engineer in consultation with the Planning Director, County Attorney, Orange <br /> County Health, and other essential County personal involved with the process. <br /> 6. Orange County Environmental Health and the staff engineer shall approve the off- <br /> site septic line construction drawings, including stubbed out service lines for lots <br />
