17 <br /> With respect to the submission of the memo, Planning staff did not receive <br /> the document until August 16, 2012 after the public hearing package had <br /> been completed and mailed to BOCC and Planning Board members. <br /> No further comment necessary, the applicant concurs with the responses providing by <br /> the Planning Staff and is of the opinion that the initial comment has been adequately <br /> addressed. <br /> • BOCC and Planning Board members expressed concern over the sample <br /> homeowners association (HOA) documents and asked the developer to provide <br /> specific HOA documents for this project. Board members identified specific <br /> examples of the sample document contradicting applicant testimony. <br /> A BOCC member expressed concern over a HOA requirement for a minimum <br /> building size for a single-family residence. <br /> Staff Comment: Submission of HOA documents is not a required component <br /> of the application. <br /> The sample document was submitted so BOCC and Planning Board <br /> members could have an understanding of how the applicant manages their <br /> projects and obtain an understanding on some of the limitations and <br /> standards normally incorporated into a Weekly Homes LLC project. <br /> The applicant concurs with the responses providing by the Planning Staff and is of the <br /> opinion that the initial comment has been adequately addressed. Additionally,please <br /> note that the documents provided were neither all inclusive nor exhaustive and will <br /> adhere to all current local and state laws. <br /> • BOCC and Planning Board members asked if the applicant would prohibit the <br /> location of solar arrays within the project. A BOCC member cited specific <br /> language within the submitted HOA documents indicating solar arrays would not <br /> be permitted. <br /> Staff Comment: The County Attorney indicated during the meeting recent <br /> modifications to State law prohibits a local HOA from adopting such a <br /> limitation. The applicant indicated this was not there intent and would ensure <br /> the final HOA document(s) associated with the subdivision would allow for the <br /> location of solar arrays. <br /> No further comment necessary, the applicant concurs with the responses providing by <br /> the Planning Staff and is of the opinion that the initial comment has been adequately <br /> addressed. <br /> • A BOCC member inquired about the transfer of mineral rights for the proposed <br /> lots. <br /> Staff Comment: The applicant indicated they were not intending to transfer or <br /> sell mineral rights to third parties for development purposes. <br /> No further comment necessary, the applicant concurs with the responses providing by <br /> the Planning Staff and is of the opinion that the initial comment has been adequately <br /> addressed. <br /> • BOCC and Planning Board members requested the site plan and HOA <br /> documents be revised to require local, indigenous, drought tolerant vegetation <br /> throughout the project were landscaping is required. <br />
