14 <br /> 1 <br /> 2 <br /> 3 Item 7e-Transit Interlocal Implementation Agreement- Paragraph 10 <br /> 4 PROPOSED CLARIFICATION FROM COMMISSIONER GORDON <br /> 5 <br /> 6 Tonight's meeting agenda includes item 7-e concerning the Transit Interlocal Implementation <br /> 7 Agreement. <br /> 8 <br /> 9 1 will be proposing the addition of some clarifying language to Paragraph 10 which deals with <br /> 10 benchmarks. <br /> 11 <br /> 12 1 have asked the County Attorney about this clarification and he told me the additional language <br /> 13 was fine with him. <br /> 14 <br /> 15 INFORMATION ON PARAGRAPH 10 <br /> 16 <br /> 17 Paragraph 10 states that benchmarks will be developed for inclusion in the transit plan, and <br /> 18 when that will happen. However, it does not clearly state how and when the benchmarks will <br /> 19 actually be used. <br /> 20 <br /> 21 Therefore, tonight I propose that we add the following language to the end of paragraph 10: <br /> 22 <br /> 23 "and to use these benchmarks and timeline in the reviews set out in paragraph 9 above and in <br /> 24 paragraph 13 below." <br /> 25 <br /> 26 (Paragraph 9 refers to the four year reviews and Paragraph 13 refers to the eight year review.) <br /> 27 <br /> 28 PARAGRAPH 10 WOULD THEN READ AS FOLLOWS: <br /> 29 <br /> 30 The Parties agree to develop appropriate benchmarks and timeline to evaluate progress in <br /> 31 gaining federal and state financial support for the LRT project in the Plan during the four years <br /> 32 following execution of the Agreement, to incorporate these benchmarks and timeline into the <br /> 33 Plan during the first four year review, and to use these benchmarks and timeline in the reviews <br /> 34 set out in paragraph 9 above and in paragraph 13 below. <br /> 35 <br /> 36 <br /> 37 A motion was made by Commissioner Gordon, seconded by Commissioner Yuhasz to <br /> 38 approve the changes in the agreement as proposed above. <br /> 39 VOTE: UNANIMOUS <br /> 40 <br /> 41 Frank Clifton made reference to paragraph 7 in the light pink handout. He said that <br /> 42 Chapel Hill Transit has some concerns and these are included in the orange handout that he <br /> 43 had prepared.
