9 <br /> 1 <br /> 2 A motion was made by Commissioner McKee, seconded by Commissioner Hemminger that <br /> 3 there is sufficient evidence in the record that complies with Section 5.3.2 (A) (2) of the <br /> 4 Ordinance in that the use will maintain and promote the public health, safety, and general <br /> 5 welfare if located where proposed in the development and operated as the plan is submitted. <br /> 6 <br /> 7 VOTE: UNANIMOUS <br /> 8 <br /> 9 A motion was made by Commissioner, McKee seconded by Commissioner Yuhasz finding <br /> 10 there is sufficient evidence in the record the project complies with Section 5.3.2 (A) (2) (a) of <br /> 11 the UDO in that the use will maintain and promote the public health, safety and general <br /> 12 welfare, if located where proposed and developed and operated according to the plan as <br /> 13 submitted. <br /> 14 <br /> 15 This motion is based on competent material and evidence entered into <br /> 16 the record of these proceedings, including: <br /> 17 <br /> 18 • Attachment 1, the application, of the public hearing abstract, <br /> 19 • Staff and applicant testimony from the Public Hearing, <br /> 20 • Abstracts from the May 29, 2012 Quarterly Public Hearing and <br /> 21 July 11, 2012 Planning Board, <br /> 22 . Staff findings as discussed during the July 11, 2012 Planning <br /> 23 Board regular meeting, and <br /> 24 • A lack of competent material and substantial evidence in the form <br /> 25 of testimony, exhibits, documents, plans, or other materials <br /> 26 entered into the record indicating the applicant had not met their <br /> 27 burden in accordance with Section 5.3.2 (A) of the LIDO. <br /> 28 <br /> 29 VOTE: UNANIMOUS <br /> 30 <br /> 31 A motion was made by Commissioner Yuhasz, seconded by Commissioner Hemminger finding <br /> 32 there is sufficient evidence in the record that the project complies with Section 5.3.2 (A) (2) (b) <br /> 33 of the UDO in that the use will maintain the value of contiguous property. <br /> 34 <br /> 35 This motion is based on competent material and evidence entered into <br /> 36 the record of these proceedings, including: <br /> 37 <br /> 38 • Applicant testimony from the Public Hearing, <br /> 39 • Abstracts from the May 29, 2012 Quarterly Public Hearing and <br /> 40 July 11, 2012 Planning Board, and <br /> 41 • A lack of competent material and substantial evidence in the form <br /> 42 of testimony, exhibits, documents, plans, or other materials <br />
