Article 6: Development Standards 87 <br /> Section 67:Additional Standards for MPD-CZD <br /> (2) Any structures proposed for removal shall either be moved to another location for <br /> re*-use contemporaneously with the construction of the new structure or be <br /> deconstructed in such a manner that the resultant materials are suitable for re- <br /> use by the deconstructing party or others in future building,projects. It is the <br /> intent of this Sub-Section that the removed structure be recycled to the extent <br /> Poswds. <br /> 6.6.3 Major Transportation Corridor(MTC) <br /> (A) Landscaping and Buffers <br /> In addition to the requirements set forth in Section 6.8 of this Ordinance,the following <br /> standards shall be met: <br /> (1) A minimum of 100 feet of buffer area from the edge of the interstate I1jgl1WaY,S94 <br /> right of way, shall be preserved. The purpose of this buffer is to protect, preserve <br /> and promote the visual appeal, character and value of land adjacent to major <br /> transportation facilities;to provide for the separation Of spaces;and to promote <br /> the public health, safety and welfare through minimizing potential nuisances such <br /> as the transmission of noise, odor, dust, litter and glare of lights. <br /> (2) In areas of dense mature forest, existing vegetation may be used to fulfill the <br /> buffer requirements. Where there is no existing vegetation in the buffer area,or <br /> if existing vegetation does not provide a sufficient buffer, all proposed plantings <br /> must be shown on the landscape plan to fulfill the buffer requirement. The new <br /> plantings shall be predominantly evergreen and shall reach a mature size of at <br /> least 30 feet. New trees shall be located so as to establish at maturity a <br /> continuous screen in the 100 foot buffer area along the adjacent interstate <br /> highway. <br /> (3) Landscaping shall be in accordance with an approved landscaping plan. <br /> (4) Any areas left in a natural state shall remain undisturbed except as follows: <br /> (a) Within the buffer areas, necessary ingress, egress and utility service may <br /> be allowed, but no other disturbance for site improvements shall be <br /> permitted. <br /> (b) Selective clearing of vegetation may be allowed only to remove diseased <br /> trees or trees weakened by age, storm,fire or other injury. <br /> (6) Non-residential uses within Transition Areas,as designated by the <br /> Comprehensive Plan, may provide one break in the required buffer per lot <br /> adjacent to the interstate right-of-way in order to provide an on-site commercial <br /> sign and/or building visibility. The break shall constitute no more than 50%of the <br /> interstate highway frontage. <br /> iSECTION 6.7: ADDITIONAL STANDARDS IF•R MPD-CZD <br /> 6.7.1 Master Plan <br /> (A) All applications for the MPD-CZ designation shall be prepared in accordance with Section <br /> 2.9 of this Ordinance and shall include a general development plan herein called the <br /> 'Master Plan'. <br /> 94 Staff is suggesting this language be added to make it clear that the buffer is required adjacent to the Interstate <br /> right-of-way,not adjacent to any local roads that may also be located within the MTC overlay. <br /> 95 Staff is suggesting that some clearing of the MTC buffer be permitted in order to provide on-premise signage <br /> abilities and building visibility adjacent to Interstates. The current potential limit is 25%of the interstate frontage <br /> [see Section 6.8.12(0)(5)]. 50%is suggested to be more competitive and in keeping with expectations of the <br /> development community while preserving an acceptable level of buffers/vegetation in areas designated for growth. <br /> Orange County,North Carolina—Unified Development Ordinance Page 6-40 <br />
