Article 1: Administration <br />Section 1.4:Planning Director <br />SECTION 1.4:PLANNING DIRECTOR <br />1.4.1Responsibilities <br />(A)The Planning Director, or his/her designee, shall have the responsibility for the <br />administration, interpretation, and enforcement of this Ordinance. <br />(B)Within this Ordinance, ‘Planning Director’ is synonymous with the individual actually <br />serving in that capacity or a designated employee unless otherwise specified. <br />(C)The Planning Directoris an employee of the County hired by and reporting to the County <br />Manager and shall have the following duties in respect to this Ordinance: <br />(1)Administering all provisions of this Ordinance for which administrative <br />responsibilities are not otherwise expressly assigned; <br />(2)Making interpretations of the provisions of this Ordinance; <br />(3)Reviewing all applications submitted in accordance with the requirements of this <br />Ordinance to ensure compliance withthe provisions of this Ordinance; <br />(4)Coordinating County staff’s compliance with duties and responsibilities specified <br />in this Ordinance; <br />(5)Preparing reports for, submitting recommendations to, and seeking input from, <br />the Planning Boardfor all matters for which this Ordinance requires review and <br />approval by the Planning Board; <br />(6)Maintaining records of the Planning Board’s meetings and actions; <br />(7)AmendingEnsuringthe text of this Ordinance and the zoning atlas are modified <br />to reflect any amendments approved by the Board of County Commissioners and <br />maintaining up-to-date originals and copies of these documents; <br />(8)Conducting on-going regular reviews of the text of this Ordinance and proposing <br />amendments necessary to implement and ensure consistency with the policy <br />objectives of the County; <br />(9)Maintaining records of the Board of Adjustment’s meetings and actions; <br />(10)Reporting any variances or interpretations of the location of the boundary of an <br />area of special flood hazard area tothe Federal Insurance Administration upon <br />request; and <br />(11)Granting Zoning Compliance Permits, making inspections of buildings or <br />premises, revoking permits, and any other procedures necessary to carry out the <br />enforcement of this Ordinance. <br />1.4.2Conditions on Authority <br />When rendering decisions on the approval of development projects, the interpretation of this <br />Ordinance, or the issuance of permits, the Planning Directorshall determine if the application is <br />consistent with the requirements of this Ordinance and issue all appropriate permits or other <br />approvals. The following limitations apply: <br />(A)Issuance of a permit authorizing the excavation, construction, moving, alteration, or use <br />of land shall in no case be construed as waiving any provision of this Ordinance. <br />(B)Under no circumstances is the Planning Directorpermitted to grant exceptions to the <br />actual meaning of any clause, standard, or regulation contained in this Ordinance to any <br />person making application to excavate, construct, move, alter, or use either building, <br />structures or land. <br />(C)Under no circumstances is the Planning Directorpermitted to make changes to this <br />Ordinance or to vary the terms of this Ordinance in carrying out assigned duties. <br />Orange County, North Carolina –Unified Development Ordinance <br />Page 1-9 <br /> <br />
